Terms and Conditions for Ticksy

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Ticksy mobile application (the "App") provided by Blue Peak Software Solutions ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Ticksy is a daily planner that lets you create and organize tasks, reminders, and notes.

2. Description of Service

Ticksy provides:

  • Tasks and reminders with dates, times, colors, tags, and completion status.
  • Notes for free-form text.
  • Local and push notifications for the reminders you schedule.
  • Personalization such as theme (light/dark/system) and language (English/Spanish).

Your content is stored and synced using cloud infrastructure (Supabase) so it is available across sessions and devices.

3. User Accounts and Registration

  • You must provide accurate information to create an account.
  • You are responsible for keeping your credentials secure and for all activity under your account.
  • You must be at least 13 years old to create an account and use the App.

4. User Content

  • You retain ownership of the content you create (tasks, reminders, notes).
  • You grant us a limited license to store, process, and display that content solely to operate the App for you.
  • You are responsible for the content you create and for ensuring you have the right to store it.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the App or its systems.
  • Upload content that is illegal, harmful, or infringes the rights of others.

6. Advertisements

The App may display advertisements provided by third parties (such as Google AdMob) to support its free version. Your use of the App is subject to the ad providers' policies as described in our Privacy Policy.

7. Notifications

The App can send you notifications and reminders that you schedule. You can manage or disable them through your device settings. We are not responsible for missed notifications caused by device settings, connectivity, or operating system limitations.

8. Intellectual Property

The App, including its design, branding, and software, is owned by Blue Peak Software Solutions and protected by applicable laws. These Terms do not grant you any rights to our trademarks or intellectual property.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that reminders will always be delivered. Ticksy is a productivity tool and should not be relied upon for critical, medical, or safety-related reminders.

10. Limitation of Liability

To the maximum extent permitted by law, Blue Peak Software Solutions shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the App.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the App and its users.

12. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last Updated" date above and, where appropriate, notify you within the App. Continued use of the App after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

14. Severability and Entire Agreement

If any provision of these Terms is held invalid, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
